At DatePhotos.ai, we take your privacy seriously. This Privacy Policy explains how we collect, use, store, and protect your personal information when you use our AI photo generation service.

By using our Service, you agree to the collection and use of information in accordance with this policy.

✶Information We Collect

We collect the following types of information:

Personal Information

  • Email address (for account creation and communication)
  • Name (optional, for personalization)
  • Payment information (processed securely by our payment partners; we never see your card number)

Photos

  • Photos you upload for AI model training
  • Generated AI photos from our service
  • Metadata associated with uploaded photos (file size, format)

Usage Data

  • IP address and browser information
  • Pages visited and features used
  • Time and date of visits
  • Diagnostic and performance data

✶How We Use Your Information

We use your information for the following purposes:

  • Service Delivery: To train AI models and generate your photos
  • Account Management: To create and maintain your account

✶Photo Upload and Processing

Your photos are handled with the utmost care and security.

What We Do:

  • Send photos over encrypted (HTTPS) connections
  • Use your photos only to train your own private AI model and to run the features you choose
  • Share photos only with the processors listed under Third-Party Services, solely to run the Service
  • Delete your uploaded selfies on a fixed schedule (see Data Retention)
  • Never use your photos to train models for other users

What We Don't Do:

  • Sell or license your photos to third parties
  • Use your photos for marketing without permission
  • Share your photos on social media or public galleries
  • Include your photos in our general AI training datasets

✶Data Storage and Security

We use the following measures to protect your data:

  • Photo Storage: Photos are stored on Cloudflare R2. Cloudflare encrypts stored files at rest, and all transfers use HTTPS.
  • Unlisted Links: Each photo is served from a long, random, unlisted URL. We don't publish these links, but anyone who has a photo's exact link can open it, so don't share your links if you want to keep a photo private.
  • Account Data: Account and order records are stored in a managed PostgreSQL database (Neon).
  • Access Controls: Limited staff access on a need-to-know basis

✶Third-Party Services

We use the following third-party services:

Payment Partner (Merchant of Record)

Purchases are processed by our third-party payment partner, which acts as the merchant of record for your transaction. The partner's name may appear on your card statement and on the checkout page, where its own privacy policy and terms are linked. We never store your full card details on our servers.

Replicate (AI Training and Processing)

Your selfies are sent to Replicate to train your private AI model and to generate your photos. Replicate also runs our photo quality check and photo scoring, which use OpenAI vision models hosted on Replicate. Files sent to Replicate are kept according to Replicate's own data retention policy.

fal.ai (Photo Generation and Backup Processing)

fal.ai generates photos from your private AI model. If Replicate is unavailable, fal.ai also trains your model and runs the photo quality check, using OpenAI vision models hosted on fal.ai.

Kie.ai (Photo Studio and Free Tools)

When you use Photo Studio features or our free photo tools, the photos you choose for that feature are sent to Kie.ai for processing.

Google Gemini and WaveSpeed (AI Analysis)

Profile Audit, the AI Opener Generator and the AI assistant's photo feedback send the screenshots or photos you submit to a Gemini model, either directly through Google's Gemini API or through WaveSpeed. They are processed to produce your result and are subject to those providers' data processing terms.

Cloudflare R2 and Neon (Storage)

Photos are stored on Cloudflare R2. Account and order data are stored in a Neon PostgreSQL database.

Resend (Email)

We use Resend to send sign-in codes and order emails. It receives your email address.

Google Analytics (Optional)

We use Google Analytics, loaded through Google Tag Manager, to understand usage patterns. You can opt out using browser extensions or privacy settings.

Google Ads (Advertising Measurement)

We use Google Ads to advertise our Service and to measure which ads lead to purchases. When you complete a purchase, we send Google the purchase event (order ID, amount and currency). For visitors in the United States and Canada, we also send a one-way hashed (SHA-256) version of the email address on your account, which Google uses only to match the purchase to an ad interaction. We do not send your email in readable form, and we do not send your photos. You can manage ad personalization at Google My Ad Center.

✶Data Retention

  • Uploaded Selfies: Deleted automatically 30 days after your AI model finishes training. We keep them for those 30 days so your free regeneration can reuse the same photos. If you upload photos but never place an order, they are deleted 30 days after upload.
  • Photos You Reuse in Photo Studio: Selfies you also use in Photo Studio stay available there until you delete them from Photo Studio or ask us to delete your account.
  • Training Archives: The bundle of selfies we prepare for training is deleted automatically after 30 days.
  • Deleted Photos: Photos you delete from your dashboard disappear right away and are permanently erased from storage within about five weeks.
  • Generated Photos: Kept in your dashboard so you can download them again, until you delete the project or ask us to delete your account. Deleting a project removes its photos right away, except copies you have also added to Photo Studio.
  • Account Data: Retained while your account is active
  • Payment Records: Kept for 7 years for tax and legal compliance

To permanently delete your account and all of your photos, contact us at support [at] datephotos.ai.

✶Your Rights

You have the following rights regarding your personal data:

  • Access: Request a copy of all data we hold about you
  • Rectification: Correct any inaccurate or incomplete information
  • Deletion: Delete projects and photos yourself from your dashboard, or email us to delete your account and all associated data
  • Data Portability: Receive your data in a machine-readable format
  • Opt-Out: Unsubscribe from marketing communications at any time

We use cookies and similar technologies for:

  • Authentication and session management
