Terms of Service

By accessing and using DatePhotos.ai ("Service"), operated by Jacob Logic Technology LLC, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use our Service.

These Terms of Service apply to all users of the Service, including without limitation users who are browsers, customers, and/or contributors of content.

DatePhotos.ai is an AI-powered photo generation service that creates professional-quality photos for dating profiles. Our service includes:

• AI model training based on uploaded photos
• Generation of 80-180 photos across diverse scenes
• Platform-specific optimization for Tinder, Bumble, and Hinge
• Quality scoring and automatic photo selection
• High-resolution photo downloads

The Service is provided on an "as-is" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

To use our Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.

Our Service operates on a pay-per-project model with three pricing tiers:

• Basic Plan - $29 for 80 photos
• Pro Plan - $49 for 120 photos (includes featured selection)
• Ultimate Plan - $79 for 180 photos

Every Photo Package includes one free regeneration within 30 days of purchase if you are not satisfied with the result. See our Refund Policy for details.

Prices shown in USD. Checkout is also available in EUR and GBP; the amount charged in those currencies is shown at checkout before you pay.

All payments are processed securely by our payment partners (Anyway or Clink), who act as the merchant of record; their name may appear on your card statement. By providing payment information, you authorize us to charge the selected payment method for the chosen service tier.

Prices are subject to change with 30 days' notice to existing customers.

Mobile App Subscriptions (iOS)

The DatePhotos AI mobile app offers auto-renewable subscriptions managed through Apple's App Store:

• Weekly — $4.99/week, auto-renews every 7 days
• Yearly — $39.99/year, auto-renews every 12 months

Subscriptions unlock unlimited access to Realness Score, AI Conversation Helper, and Profile Audit features. Payment is charged to your Apple ID account at confirmation of purchase.

Auto-Renewal: Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Cancellation: You can cancel your subscription at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period. No partial refunds are given for unused portions of a subscription period.

Free Trial: If offered, any unused portion of a free trial is forfeited when you purchase a subscription.

Your Photos: You retain all rights to the photos you upload to our Service. By uploading photos, you grant us a limited license to use them solely for AI model training and photo generation.

Generated Photos: All AI-generated photos created by our Service are owned by you. You have full commercial and personal usage rights without attribution required.

Our Platform: The DatePhotos.ai platform, including its design, features, and underlying technology, is protected by copyright and other intellectual property laws.

You agree NOT to use our Service to:

• Upload photos of individuals without their consent
• Create photos for fraudulent or deceptive purposes
• Generate content that violates any applicable laws
• Upload sexually explicit, violent, or offensive content
• Attempt to reverse engineer or replicate our AI technology
• Resell or redistribute generated photos as a service
• Use the Service to create photos of minors

Violation of these terms may result in immediate account termination without refund.

DatePhotos.ai generates images and text (including dating photos, AI coach replies, profile bios, and conversation openers). This policy applies to everything you upload to the Service and everything the Service generates for you, and supplements the Prohibited Uses above.

Prohibited Content

You may not use the Service to upload, request, generate, or distribute:

• Hate speech: content that attacks, threatens, dehumanizes, or promotes discrimination against individuals or groups on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any similar characteristic.
• Deepfakes and impersonation: images of any real person other than yourself, including public figures, celebrities, or private individuals, created or edited without that person's explicit consent; and any AI-generated image presented as an authentic photograph of someone you are not.
• Copyright and trademark infringement: photographs, artwork, logos, brand marks, or designs you do not own or have permission to use, and any output that reproduces protected works or marks.
• Sexual, violent, and child-safety violations: sexually explicit or pornographic content, graphic violence or gore, and any content depicting or sexualizing minors, as already set out in Prohibited Uses. Content involving minors is reported to the relevant authorities.
• Fraud and harassment: content intended to deceive, defraud, scam, stalk, harass, or intimidate any person, including fake dating profiles built on someone else's likeness.

Reporting Violations

If you encounter content or an account that you believe violates this policy, report it through the Contact page by selecting the subject "Report Content Violation", or email support [at] datephotos.ai with the subject line "Content Report". Please include the page URL, the account or image concerned, and a short description of the issue.

• We acknowledge every report within 24 hours.
• We review the report and take action within 72 hours of receipt.
• We inform the reporter of the outcome where permitted by law and privacy obligations.

Moderation and Enforcement

• Automated safeguards: generation requests are processed through the content safety systems of our AI providers, which block requests and outputs that match prohibited categories before the image is delivered.
• Human review: reports and flagged activity are reviewed manually by our team.
• Enforcement actions: depending on severity and history, we may remove the content, issue a warning, restrict features, or terminate the account without refund, as set out in Prohibited Uses.
• Records and legal cooperation: we retain records of enforcement actions and cooperate with lawful requests from law enforcement and regulators.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted or error-free
• Generated photos will meet your specific expectations
• All technical issues will be corrected
• The Service will be available at all times

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JACOB LOGIC TECHNOLOGY LLC, DOING BUSINESS AS DATEPHOTOS.AI, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims related to the Service shall not exceed the amount you paid for the Service.

These Terms of Service and any dispute arising from or relating to the Service are governed by the laws of the State of Wyoming and the applicable federal laws of the United States, without regard to conflict of law principles.

You agree that any legal action or proceeding related to these Terms or the Service will be brought in a court of competent jurisdiction located in the United States, unless applicable law requires otherwise.

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or through the Service.

Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.
